תקנון שימוש באתר Did.Li
1. כללי
1.1. אתר Did.Li דידלי (“האתר”) מופעל על־ידי חברת שיחה ותוצאה בע״מ (ח.פ. 513884932) (“החברה”), ומשמש כאתר שירות לקיצור קישורים/לינקים (“השירות”).
1.2. התקנון מנוסח בלשון זכר מטעמי נוחות בלבד, והוא מתייחס לכל המגדרים באופן שווה.
1.3. עצם השימוש באתר, לרבות יצירת קיצור לינק, מהווה הצהרה והסכמה מצד המשתמש כי קרא את התקנון, הבין אותו והסכים לו.
2. שימוש תקין בשירות
2.1. המשתמש מתחייב ליצור לינקים תקינים, חוקיים ואמינים בלבד.
2.2. חל איסור מוחלט להקים קישורים המובילים לתוכן לא חוקי, הונאה, ספאם, חומרים פוגעניים, פורנוגרפיה, הסתה, עבירות זכויות יוצרים, סימני מסחר או הפרה אחרת של קניין רוחני.
2.3. החברה שומרת לעצמה את הזכות להסיר, לחסום או למחוק כל קישור או משתמש לפי שיקול דעתה, בכל עת וללא הודעה מראש.
3. עמוד ביניים, פרסומות ופתיחת לשוניות
3.1. המשתמש מאשר ומסכים כי האתר רשאי, כחלק מפעולת השירות או מטעמי תפעול/מוניטיזציה, להציג עמוד ביניים (interstitial page) בין הקישור המקוצר לבין היעד הסופי.
3.2. המשתמש מאשר ומסכים כי עמוד ביניים עשוי לכלול תכנים, הצעות, פרסומות או כל מרכיב שיווקי אחר, לרבות כפתור פעולה (CTA).
3.3. האתר רשאי לפתוח לשונית דפדפן נוספת, חלון חדש או להפנות את המשתמש לצד ג’ בהתאם להגדרות השירות או לצורכי תפעול/פרסום.
3.4. עצם השימוש בשירות מהווה הסכמה מראש לביצוע פעולות אלו, וללא צורך בהסכמה נוספת בכל פעם.
4. אחריות לתכנים מקושרים
4.1. השירות מספק מנגנון הפניה בלבד ואינו אחראי לתכנים המצויים ביעדי הקישורים.
4.2. החברה אינה מסננת, מפקחת או מאשרת את התכנים אליהם מופנים הלינקים.
4.3. אחריות מלאה לתוכן היעד חלה על המשתמש שיצר את הקישור בלבד.
5. דיווח על שימוש לרעה
5.1. ניתן לדווח על שימוש לרעה במערכת באמצעות עמוד דיווח ייעודי באתר.
5.2. החברה רשאית לחסום ו/או למחוק משתמשים וקישורים אשר עלולים לפגוע בבטיחות הציבור, באבטחת האתר או בכללים הנ״ל.
6. הגבלת אחריות
6.1. החברה לא תהיה אחראית לכל נזק ישיר, עקיף, משני, מיוחד או תוצאתי הנגרם עקב השימוש או אי־השימוש באתר, לרבות אובדן מידע, עיכוב, תקלה או הפרעה בשירות.
6.2. השימוש באתר הינו באחריות המשתמש בלבד, והמשתמש ישא בכל נזק ו/או חבות שתיגרם לו או לצדדים שלישיים עקב שימושו בשירות.
6.3. החברה לא תחוב בכל נזק הנובע מכוח עליון, מתקלה טכנית, פריצה, אירועי סייבר, או פעולה שאינה בשליטתה.
7. פרטיות ושימוש במידע
7.1. החברה רשאית לאסוף נתונים תפעוליים לצורך שיפור השירות, אכיפה, סטטיסטיקה או תפעול תקין.
7.2. פרטים שנמסרים על־ידי המשתמש לא יימכרו או ייחשפו לצדדים שלישיים שלא לצרכי תפעול השירות ובהתאם לחוק.
7.3. החברה נוקטת באמצעי אבטחה מקובלים לשמירת המידע, אך במקרה של אירוע שאינו בשליטתה לא תחול עליה כל אחריות לנזק שנגרם.
8. הסכמה לשימוש במידע
8.1. בלחיצה על כפתורי האתר כגון “קצרו”, “כניסה”, “Continue” או כל פעולה אחרת בשירות, המשתמש מאשר לחברה לעשות שימוש חוקי במידע הנאסף לצורך תפעול השירות, ייעולו ואבטחתו.
9. הסרת פרטים
9.1. משתמש המעוניין להסיר עצמו מרשימות תפעול או תפוצה יכול לפנות לחברה באמצעות טופס “צור קשר”.
10. קניין רוחני
10.1. כל זכויות הקניין הרוחני באתר ובשירות, לרבות תכנים, בסיסי נתונים, עיצוב, לוגו, קוד, גרפיקה וכד’ — הנן רכושה הבלעדי של החברה.
10.2. אין להעתיק, לשכפל, להפיץ, לפרסם או לעשות שימוש בתכני האתר ללא אישור מראש ובכתב מאת החברה.
10.3. קישורים מקוצרים שנוצרו על־ידי משתמשים רשאים להפצה חופשית, בכפוף להוראות תקנון זה.
11. דין ושיפוט
11.1. פרשנות התקנון ואכיפתו ייעשו בהתאם לדין הישראלי בלבד.
11.2. לבתי המשפט המוסמכים במחוז תל אביב–יפו תהיה סמכות השיפוט הבלעדית בכל מחלוקת הנובעת מהשימוש באתר.
12. פרטיות – עמידה ב-GDPR וב-CCPA
12.1. המשתמש מודע לכך שהחברה עשויה לאסוף מידע סטטיסטי, תפעולי וטכני לצורך תפעול האתר ושיפור השירות.
12.2. ככל שהשימוש בשירות נעשה ממדינות האיחוד האירופי, החברה תפעל בהתאם ל-General Data Protection Regulation (GDPR), לרבות זכות גישה, תיקון, מחיקה (Right to be forgotten), ניידות מידע, והתנגדות לעיבוד נתונים.
12.3. משתמשים ממדינת קליפורניה זכאים לזכויות לפי California Consumer Privacy Act (CCPA), לרבות זכות לדעת איזה נתונים נאספים, זכות לבקש מחיקה וזכות לסרב למכירת נתונים.
12.4. כדי לממש זכויות אלו, ניתן לפנות לחברה באמצעות טופס “צור קשר” באתר.
13. Cookies / Analytics / Pixels
13.1. האתר עשוי להשתמש בעוגיות (Cookies), קבצי מעקב, Web Beacons, Local Storage, או מנגנוני מעקב דומים לצורכי תפקוד, אבטחה, אנליטיקות ושיפור חוויית המשתמש.
13.2. העוגיות עשויות להיות first-party (של האתר) או third-party (של גורמי צד ג’ כגון Google, Meta או רשתות פרסום).

14. Anti-Spam / Anti-Phishing
14.1. אסור להשתמש בשירות לצורך פישינג, הונאות, גיוס כספים מזויף, הפניות מטעות, התחזות לאנשים או גופים, הצעת השקעות מפוקפקות או כל פעילות המכוונת לפגיעה במשתמשים.
14.2. חל איסור להשתמש בשירות לצורך הפצת ספאם, פרסום דואר זבל, קישורי Affiliate בלתי חוקיים, או הפצה אוטומטית של לינקים ללא הסכמה וללא ערך ממשי למקבל.
14.3. החברה רשאית לחסום כל משתמש או כתובת IP המייצרת פעילות חשודה או מסוכנת, אף ללא מתן הודעה מוקדמת.
14.4. החברה רשאית לדווח לרשויות אכיפה או לספקיות אינטרנט במקרה של פעילות מזיקה.
Terms of Use – Did.Li
1. General
1.1. The Did.Li website (“the Website”) is operated by CALL AND RESULT LTD. (Israel Co. No. 513884932) (“the Company”) and provides a link shortening service (“the Service”).
1.2. The Terms are written in masculine form for convenience only and apply equally to all genders.
1.3. By using the Website, including creating a shortened link, the user declares that he has read, understood, and agreed to these Terms.
2. Proper Use of the Service
2.1. Users must create legal, valid, and lawful links only.
2.2. It is strictly prohibited to create links directing to illegal content, fraud, phishing, scams, spam, abusive or offensive content, pornography, hate, copyright infringement, trademark violations, or any other breach of intellectual property.
2.3. The Company reserves the right to delete, block, or remove any link or user at its sole discretion, at any time and without prior notice.
3. Intermediate Pages, Advertising, and Browser Tabs
3.1. The user hereby acknowledges and agrees that the Website may display an intermediate page (interstitial page) between the shortened link and the final destination.
3.2. Such intermediate pages may include promotional content, advertisements, marketing elements, and/or a call-to-action button (CTA).
3.3. The Website may, for operational or monetization purposes, open a new browser tab, new window, or redirect the user to a third party.
3.4. By using the Service, the user gives prior consent to such actions, and no further approval will be required.
4. Responsibility for Linked Content
4.1. The Service provides a technical redirection mechanism only and is not responsible for the content of any linked destination.
4.2. The Company does not monitor, approve, or endorse any external content to which links redirect.
4.3. Full responsibility for the content of the destination lies solely with the user who generated the link.
5. Reporting Misuse

5.2. The Company may block or remove users and links that endanger public safety, violate the Terms, or otherwise threaten the Website’s operation.
6. Limitation of Liability
6.1. The Company shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from the use or inability to use the Website, including data loss, delay, malfunction, or operational disruptions.
6.2. Use of the Website is at the user’s sole risk, and the user shall bear all responsibility and liability for any damage caused to him or to third parties.

10. Intellectual Property

11. Governing Law and Jurisdiction
11.1. These Terms shall be interpreted and enforced solely according to the laws of the State of Israel.
11.2. Exclusive jurisdiction shall be vested in the competent courts of the Tel Aviv–Jaffa District.
12. GDPR and CCPA Compliance
12.1. Users acknowledge that the Company may collect operational, functional, analytical, or technical data for the purpose of providing and improving the Service.
